第三条 夫妻财产制之总体约定(分别财产制) 3.1 双方同意在婚姻关系存续期间实行分别财产制:除本协议明示列为共同财产者外,任何一方的下列财产均为其个人财产: (一)婚前个人财产(详见附件一、附件二),包括但不限于:不动产、车辆、存款、有价证券、基金、股权或合伙份额、知识产权及其收益(著作权除外人格权部分)、贵重动产等; (二)婚后一方以其劳动所得、投资收益或其他合法途径取得的财产及其孳息和自然增值; (三)一方因继承或受赠取得的财产,但赠与合同或遗嘱明确赠与双方共同的除外; (四)一方专用的生活用品; (五)依法应归一方所有的其他财产。 3.2 共同财产的例外约定(如需):双方同意将下列财产作为共同财产(共同共有或按份共有),并按以下份额持有: (一)拟于____年__月后购买的家庭共同居所,产权登记为双方共有,份额为:甲方____%,乙方____%; (二)其他约定共同财产:____________________________。 3.3 名义与实质一致性:财产所有权以权属登记、有效合同或出资事实综合认定;如名义登记与实际出资不符,按实际出资比例确认受益并据此清算,但对不知悉真实出资情况之善意第三人不发生不利影响。 3.4 对外效力:夫妻财产约定对双方具有拘束力;涉及不动产、股权等须登记公示之权利,未经依法登记或有效通知第三人,不得对抗不知悉该约定的善意第三人。
第四条 债务与担保 4.1 婚前个人债务:各自承担(详见附件三)。 4.2 婚内个人债务:一方以其个人名义为非家庭日常生活需要所负之债务,未经另一方书面同意或未用于家庭共同生活、共同生产经营的,原则上由其个人承担;但法律另有规定或债权人善意且有相反证据的除外。 4.3 婚内共同债务:为家庭日常生活需要所负的债务,或经双方书面共同确认的债务,为共同债务,由双方按各自经济能力或另行约定比例承担。双方确认,超过日常生活需要的大额债务应以双方共同签字或书面确认为共同债务的成立条件之一。 4.4 对外担保:任何一方为他人提供保证、抵押、质押等担保,须取得另一方书面同意;否则因此产生的风险与责任原则上由该方个人承担,但法律对善意相对人另有保护规定的,从其规定。
第五条 家庭费用与财务管理 5.1 家庭日常费用(含住房、子女抚养与教育、医疗、赡养等)由双方按以下方式分担:甲方承担____%,乙方承担____%;或按收入比例动态调整(以最近连续三个月税前收入平均值为基准)。 5.2 双方同意就重大财务事项(单笔支出或负债数额达到人民币____元及以上)共同决策并以书面记录确认。 5.3 各自银行账户、电子支付账户及投资账户独立管理;为保障家庭透明度,双方每半年相互提供主要资产负债摘要(无需披露与职业秘密或第三方保密义务冲突之事项)。
第六条 不动产与重大资产之特别约定 6.1 婚后购买不动产如登记为一方名下且使用共同资金或共同负担按揭的,双方按实际出资(含首付、按揭归还、本息比例、装修投入)确认为按份共有;若双方另有明确书面约定的,从其约定。 6.2 一方婚前不动产在婚后产生之自然增值归该方所有;另一方对该不动产的按揭归还、重大维修或装修如有实质性资金投入的,对相应增值部分可请求合理补偿。 6.3 一方持有的股权、合伙份额为其个人财产;婚后因公司利润分配形成之收益为该方个人财产;若另一方对企业经营有实质性劳动贡献且有证据证明,可就合理劳动对价另行主张。
第七条 赠与、继承与保险 7.1 对一方个人的赠与及其孳息为该方个人财产;明确赠与双方或婚后共同生活之赠与,为共同财产。 7.2 一方继承取得之财产为该方个人财产;遗嘱或遗赠扶养协议另有明确指向的,从其指向。 7.3 人身保险:投保人、被保险人、受益人依保险合同确定。保险金归属按保险法及保险合同约定执行;若以共同资金缴纳保费且归属争议,按出资与约定综合认定。
第八条 子女有关事项 8.1 子女监护权、抚养权及探望权的确定,以未成年子女最佳利益原则为基本考量,依法律规定及届时具体情况处理。本协议任何与该原则相冲突之约定,均不发生效力。 8.2 子女抚养费用在离婚时由双方协商或由人民法院依法裁判确定;双方同意,若届时无更优安排,可参考双方收入比例分担,并随子女成长、教育与医疗需要动态调整。
第九条 离婚时的财产清算与经济补偿 9.1 在分别财产制下,离婚时各自个人财产归各自所有;共同财产(如有)按约定份额或协商分割,协商不成的,依法处理。 9.2 家务劳动补偿:婚姻存续期间如一方因承担更多家务劳动、抚育子女或照料老人等导致自身发展机会明显受限,离婚时有权依法请求对方给予经济补偿。双方同意可参考如下计算框架协商确定补偿数额:每满一年按人民币____元基础标准计,并结合婚姻存续期间家庭人口、家务劳动强度、对职业发展的影响程度、对对方事业支持程度等因素综合调整;若显失公平,法院可依法变更。 9.3 生活困难扶助(抚养/扶助义务):离婚后,一方生活确有困难的,另一方应依法给予适当扶助。任何一方均不得通过本协议预先完全排除对方依法享有的该项请求权。 9.4 过错损害赔偿:如存在法定过错情形(例如重婚、与他人同居、实施家庭暴力、虐待或遗弃家庭成员等),无过错方可依法请求损害赔偿;双方可以在届时就精神损害抚慰金及相关损失另行协商,协商不成的,由法院依法裁判。
第十条 违约责任 10.1 任何一方违反本协议约定义务,给对方造成损失的,应承担违约责任,包括但不限于继续履行、损害赔偿、恢复原状、合理费用支出(包括律师费、公证费、评估费等)。 10.2 因重大隐瞒、虚假披露或转移、隐匿财产致对方合法权益受损的,受损方有权请求法院依法予以处罚性救济;情节严重的,受损方并可据此主张不利于违约方之财产分割安排。
第十一条 个人权利与人格尊严 11.1 双方尊重彼此人格权、名誉权、隐私权与人身自由。任何形式的家庭暴力、精神虐待或控制行为均被明确禁止;受害方有权依法申请人身安全保护令并寻求民事、行政或刑事救济。 11.2 本协议不得限制任何一方受教育权、就业权及社会交往之合理行使。
第十二条 保密与数据保护 12.1 除依法提交公证、登记、诉讼或仲裁所需外,任何一方未经对方书面同意,不得向第三方披露本协议内容及附件涉及之个人敏感信息。 12.2 为实现本协议之目的而必要披露时,披露方应尽合理注意义务,确保仅向有必要知悉之主体披露且限于必要范围。
第十三条 适用法律与争议解决 13.1 本协议之订立、效力、履行、变更、解除与争议解决,适用中华人民共和国法律。 13.2 因本协议产生之争议,双方应先行协商;协商不成的,任一方可向本协议签订地或被告住所地有管辖权的人民法院提起诉讼。涉及婚姻关系存续、身份关系或子女抚养之争议,不适用仲裁。
第十四条 协议变更与解除 14.1 本协议生效后,任何变更、补充或解除须采用书面形式,并由双方签字(必要时办理公证或登记手续)。补充协议与本协议具有同等法律效力。 14.2 如本协议部分条款被确认无效、可撤销或不可执行,不影响其他条款之效力。为实现双方真实意思表示,相关条款应在法律允许范围内被解释为尽可能接近双方原意的有效条款。

Prenuptial Agreement
This Prenuptial Agreement (the “Agreement”) is made as of [date], by and between Wang Yu (“Wang”) and Zhao Min (“Zhao,” and together with Wang, the “Parties”).
Recitals
A. The Parties contemplate a lawful marriage on or about [wedding date] (the “Marriage”), and they desire to define and determine their respective rights and obligations in property, income, debts, and support, both during the Marriage and upon the occurrence of separation, dissolution, annulment, death, or any other marital event.
B. Each Party acknowledges that: (i) this Agreement is executed voluntarily and free of duress, undue influence, fraud, mistake, or coercion; (ii) each has had a reasonable and sufficient opportunity to retain and consult independent legal counsel of their choice, and either has done so or knowingly and expressly waives such right; and (iii) each has made, prior to execution, a fair and reasonable disclosure of their property, income, and financial obligations, as reflected in Schedules A (Wang) and B (Zhao), and each waives any further disclosure to the extent permitted by law.
C. The Parties intend this Agreement to be valid and enforceable to the maximum extent permitted under applicable law, including generally recognized principles reflected in the Uniform Premarital Agreement Act and/or the Uniform Premarital and Marital Agreements Act, as enacted or applicable in the chosen governing jurisdiction, namely: voluntariness, fair and reasonable disclosure or informed waiver, and substantive fairness at execution and at enforcement to the extent required by law.
D. The Parties acknowledge that provisions affecting the rights of children, including custody, parenting time, and child support, are subject to the best-interests-of-the-child standard and the continuing jurisdiction of a court of competent authority, and that no provision herein shall impair such rights or the authority of such court.
Agreement
Definitions 1.1 “Separate Property” means all property, assets, and income owned or controlled by a Party as of the Effective Date (as defined in Section 16), including the property described in that Party’s Schedule, together with all increases, appreciation, substitutions, proceeds, rents, dividends, interest, and income therefrom, whether acquired before or after the Marriage, and any property acquired thereafter in that Party’s sole name that is not expressly designated as Joint Property in a signed writing. 1.2 “Joint Property” means property expressly titled in the names of both Parties as joint tenants, tenants by the entirety, or tenants in common, or designated in a signed writing by both Parties as joint or marital property. 1.3 “Debts” means all liabilities, obligations, taxes, and indebtedness of any nature, whether contingent, liquidated, or unliquidated.
Separate Property Regime 2.1 Confirmation. Each Party shall retain sole ownership, control, and disposition rights over his or her Separate Property, free and clear of any claim or marital interest by the other, except as expressly provided in this Agreement. 2.2 Earnings. Unless otherwise agreed in a signed writing, all earnings, income, bonuses, stock options or equity awards, carried interest, intellectual property and royalties, and any other remuneration earned by a Party after the Marriage shall be and remain that Party’s Separate Property, together with any assets acquired therewith, except to the extent explicitly transferred into Joint Property by written instrument. 2.3 Title Controls. Titling of an asset in one Party’s sole name creates a rebuttable presumption (intended by the Parties to be conclusive between them) that such asset is Separate Property. Titling in both names creates a presumption that the asset is Joint Property, shared in equal undivided interests unless otherwise stated in the instrument of title or a contemporaneous written agreement.
Joint Property 3.1 Creation. Joint Property shall arise only upon: (a) joint titling in both Parties’ names; or (b) a signed writing executed by both Parties describing the property as Joint Property and their respective beneficial interests. 3.2 Disposition. Upon dissolution or legal separation, Joint Property shall be divided in accordance with title or, if a different beneficial interest is stated in writing, in accordance with such statement. If neither provides guidance, Joint Property shall be divided equally.
Transmutation and Commingling 4.1 No Implied Transmutation. No gift, use, commingling, or management of property, nor deposit of Separate Property into an account, shall transmute Separate Property into Joint Property absent a signed writing that clearly manifests an intent to transmute. 4.2 Tracing. If Separate Property is commingled with marital or joint funds, the contributing Party may trace and recover the Separate Property portion to the extent reasonably possible.
Debts 5.1 Pre-Marital Debts. Each Party shall be solely responsible for his or her Debts incurred prior to the Marriage and shall indemnify and hold harmless the other Party from such Debts. 5.2 Post-Marital Debts. Debts incurred by a Party after the Marriage shall be that Party’s sole responsibility unless jointly undertaken in writing. Jointly undertaken Debts shall be borne by both Parties in accordance with their written agreement; absent such agreement, equally.
Business Interests and Professional Practices 6.1 Ownership. Any interest a Party holds in a business, partnership, professional practice, corporation, limited liability company, or similar enterprise, whether existing prior to or acquired after the Marriage in that Party’s sole name, shall be that Party’s Separate Property, including post-marital appreciation, goodwill (personal or enterprise), profits, and distributions, except as otherwise agreed in writing. 6.2 Reimbursement. If Joint Property or the other Party’s Separate Property makes a direct, provable contribution to the acquisition or principal reduction of a business interest that is a Party’s Separate Property, the contributing source shall be entitled to reimbursement of the amount of the contribution (but not to any share of appreciation), unless otherwise agreed in writing.
Real Property and Marital Residence 7.1 Existing Real Property. Real property owned by either Party prior to the Marriage shall remain that Party’s Separate Property, including all increase in value, except as otherwise agreed in a signed writing. 7.2 Marital Residence. If the Parties acquire or designate a marital residence: (a) Title. Ownership shall follow title. If jointly titled, it shall be presumed Joint Property with equal undivided interests unless a different percentage is specified in the deed or a contemporaneous signed writing. (b) Occupancy on Separation. Pending final resolution of dissolution, the Parties agree to first attempt to mediate occupancy arrangements. If mediation fails, a court of competent jurisdiction may determine temporary occupancy without altering title. (c) Reimbursement. Mortgage principal reduction or capital improvements funded from Joint Property shall entitle Joint Property to reimbursement from net equity before distribution, unless otherwise agreed.
Spousal Support (Alimony/Maintenance) Option A: Mutual Waiver (to the extent enforceable) 8.1 Each Party knowingly, voluntarily, and expressly waives any right to receive spousal support, maintenance, or alimony from the other upon separation or dissolution, to the maximum extent permitted by applicable law. 8.2 Savings Clause. If a tribunal of competent jurisdiction determines that a complete waiver would be unconscionable at the time of enforcement or otherwise unenforceable, the Parties agree that any support awarded shall be the minimum necessary to avoid unconscionability and shall not exceed [cap amount or formula] for a duration not to exceed [duration], absent extraordinary circumstances. Option B: Predetermined Support 8.3 In lieu of waiver, the Parties agree that, upon entry of a decree of dissolution after at least [X] years of marriage, the higher-earning Party shall pay support to the other in the amount of [amount/formula], for [duration], subject to termination upon the recipient’s remarriage or either Party’s death. This clause applies unless a court finds it unconscionable at enforcement.
Select either Option A or B; delete the other in the final executed version. Independent legal counsel is strongly recommended for any spousal support waiver or limitation.
Estate, Probate, and Elective Share Rights 9.1 Waiver. To the fullest extent permitted by law, each Party waives, releases, and relinquishes any and all rights arising by reason of the Marriage in the Separate Property of the other at death, including any elective or forced share, dower, curtesy, homestead, community property claims, exempt property, and family allowances, except as otherwise provided in a will, trust, beneficiary designation, or a separate written instrument. 9.2 ERISA/Retirement Benefits. To the extent permitted by ERISA and other applicable law, each Party disclaims any interest in the other’s retirement benefits except as expressly provided in a post-marital spousal consent or a qualified domestic relations order. The Parties agree to execute any additional post-marital consents required to effectuate these waivers. 9.3 No Limitation on Testamentary Freedom. Nothing herein restricts either Party’s right to make testamentary or inter vivos gifts or to name the other as a beneficiary.
Taxes 10.1 Filing Status. The Parties may elect any lawful filing status. Allocation of tax liabilities or refunds between the Parties shall follow the source of income and ownership of deductions/credits unless otherwise agreed in writing. 10.2 Indemnification. Each Party shall indemnify the other for any tax liabilities, penalties, and interest arising from that Party’s Separate Property income or deductions.
Gifts Between the Parties 11.1 Any interspousal gift shall be the recipient’s Separate Property only if evidenced by a contemporaneous signed writing or if the item by its nature is personal and intended as a gift (e.g., jewelry), in which case the presumption is that it is the recipient’s Separate Property.
Children 12.1 Non-Interference. Nothing in this Agreement shall affect child custody, parenting time, child support, or other rights or obligations regarding children, all of which remain subject to applicable law and the best interests of the child standard.
Disclosure; Independent Counsel; Waiting Period 13.1 Disclosure. Each Party acknowledges receipt of fair and reasonable disclosure of the other’s property and financial obligations, as listed in the attached Schedules, and waives any right to further disclosure to the extent permitted by law. 13.2 Counsel. Each Party acknowledges that they have had the opportunity to consult independent counsel of their choosing. Counsel information (if any) is set forth in Schedule C. A Party who elects not to be represented does so knowingly and voluntarily. 13.3 Review Period. The Parties acknowledge that they received the final draft of this Agreement at least [X] days before execution and had adequate time for review and consultation.
Enforcement; Remedies 14.1 Governing Law and Forum. This Agreement shall be governed by and construed in accordance with the laws of [governing state/country], without regard to its conflict-of-laws rules. Exclusive venue for any dispute shall lie in the courts of [forum], absent mandatory jurisdiction elsewhere. 14.2 Severability and Blue-Penciling. If any provision is held invalid or unenforceable, it shall be modified to the minimum extent necessary to render it enforceable, and the remainder shall continue in full force, provided the essential purpose of the Agreement is not frustrated. 14.3 Specific Performance. The Parties agree that monetary damages may be inadequate and that this Agreement may be specifically enforced.
Amendments; Revocation; Integration 15.1 Amendments. This Agreement may be amended or revoked only by a written instrument signed by both Parties, executed with the same formality as this Agreement. 15.2 Entire Agreement. This Agreement, including Schedules, constitutes the entire understanding between the Parties regarding its subject matter and supersedes all prior or contemporaneous agreements, oral or written. 15.3 No Third-Party Beneficiaries. No person other than the Parties has rights under this Agreement.
Effective Date; Execution Formalities 16.1 Effective Date. This Agreement shall become effective only upon solemnization of the Marriage. If the Marriage does not occur on or before [date], this Agreement shall be void ab initio. 16.2 Counterparts; Electronic Signatures. This Agreement may be executed in counterparts and by electronic signatures, each of which shall be deemed an original and all of which together constitute one instrument. 16.3 Acknowledgments. Each Party acknowledges that they are proficient in English or have had this Agreement translated and explained to their satisfaction, and that they understand its terms and legal consequences.
Alternative Dispute Resolution 17.1 Mediation. Before initiating litigation regarding this Agreement (other than to seek temporary relief), the Parties agree to attempt mediation in [location] with a mutually agreed mediator. Mediation costs shall be shared equally unless otherwise agreed or ordered. 17.2 Confidentiality. The Parties shall maintain the confidentiality of mediation communications to the extent permitted by law.
