1. Scope of Protection

• This notice applies to all original works of authorship fixed in any tangible medium of expression created or published by A Qing (阿青) in 2024, including but not limited to literary, artistic, photographic, audiovisual, musical, graphic, and digital works, and any compilations or selections thereof (the “Works”).
• All rights are reserved in all jurisdictions worldwide to the fullest extent permitted by applicable law, including present and future media and modes of exploitation.

2. Reservation of Rights

• The copyright owner reserves all exclusive rights under applicable law, including the rights of reproduction, distribution, public performance, public display, communication to the public, making available, and preparation of derivative works.
• No license, assignment, transfer, or other grant of rights is made or implied by the publication, display, downloadability, or accessibility of the Works.

3. Permitted Uses Without Prior Consent Subject to mandatory statutory exceptions and limitations, and provided all copyright and proprietary notices remain intact:

• Personal, non-commercial viewing and a single non-commercial copy for personal reference.
• Brief quotations for purposes such as criticism, comment, scholarship, teaching, or news reporting, only to the extent permitted by applicable law (e.g., fair use under 17 U.S.C. § 107 in the United States or fair dealing under comparable laws elsewhere).
• Transient or incidental copies technically necessary for lawful browsing, caching, or network transmission. All other uses require prior written permission. Users are solely responsible for determining whether a contemplated use is permitted under applicable exceptions.

4. Prohibited Uses (Without Written Permission)

• Any reproduction, distribution, public display, public performance, or adaptation (including translations, transformations, or derivative works), whether commercial or non-commercial, beyond the foregoing Permitted Uses.
• Any text and data mining, machine learning, or AI training using the Works, except to the limited extent unavoidably permitted by mandatory law that cannot be waived.
• Removal or alteration of copyright management information, metadata, or technological protection measures.
• Any sublicensing, sale, or other transfer of the Works or any portion thereof.
• Any use that suggests sponsorship, endorsement, or affiliation by the owner without express written consent.

5. Third-Party Materials

• The Works may contain third-party materials used under license, by permission, or pursuant to applicable exceptions. Rights in such materials are reserved by their respective owners. No license to third-party materials is granted by this notice.

6. Moral Rights

• To the maximum extent recognized by applicable law, including Article 6bis of the Berne Convention, the owner asserts and reserves moral rights, including the right of attribution and the right to object to derogatory treatment or distortion of the Works.

7. No Waiver; Severability

• No failure to enforce any right shall constitute a waiver of such right. If any provision of this notice is held invalid, the remaining provisions shall remain in full force to the maximum extent permitted by law.

8. Notice of Alleged Infringement; Takedown

• If you believe your rights are infringed by any use of the Works, please send a written notice identifying the specific material and the basis of your claim to the contact below. For claims subject to U.S. law, a notice conforming to 17 U.S.C. § 512(c)(3) should include:
  • A physical or electronic signature of the complaining party or its authorized agent;
  • Identification of the copyrighted work claimed to have been infringed;

10. Legal Effect; International Application

Nothing herein is intended to limit or waive any non-waivable statutory rights or exceptions. Unauthorized uses may give rise to civil and, where applicable, criminal liability.

1. 权利主体与适用范围

• 权利主体：岚山书社（含其依法设立或授权的关联实体、被许可人，下称“本社”）。
• 适用范围：本社以任何形式发布、传播或提供的作品与资料（包括但不限于图书及其数字版、期刊、文章、译著、选编、图片、插图、封面及版式设计、音视频资料、数据库与汇编作品、网页内容、元数据与注释、教学课件、数字文件与其预装之技术保护措施、以及本社标识与商号），均受中华人民共和国相关法律法规保护。本社标识、字号与相关品牌要素亦受《商标法》及反不正当竞争法律保护。

2. 著作权与相关权利

• 本社对其享有权利的作品依法享有著作人身权与著作财产权，包括署名权、修改权、保护作品完整权，以及复制权、发行权、出租权、展览权、表演权、放映权、广播权、信息网络传播权、摄制权、改编权、翻译权、汇编权及法律规定的其他权利。
• 对构成汇编或数据库的内容，本社对其选择与编排依法享有著作权；其中单项内容的权属不因此当然变更。
• 本社依法享有对出版物版式设计的专有使用权，未经许可，任何单位或个人不得擅自全部或实质性仿制、复制或使用相同或近似版式设计进行出版或传播。
• 本社通过许可取得之第三方作品，依许可范围行使权利；如本社明确标注为特定许可（如开放许可、集体管理许可等），应以该等许可条款为准。

3. 权利保留声明

• 除依法适用的法定许可与合理使用情形外，未经本社事先书面许可，任何单位或个人不得以任何方式对上述受保护内容进行复制、下载、存储、改编、翻译、汇编、发行、展示、出版、广播、二次传播或通过信息网络向公众提供，亦不得以数据抓取、批量爬取、镜像、训练或优化算法模型等方式进行使用。
• 对本社作品中所包含的数字水印、访问控制、加密、DRM等技术保护措施，以及权利管理电子信息，任何单位或个人不得规避、破坏、删除或以其他方式消除、修改。

4. 合理使用与法定许可

• 在不影响本社正常使用作品且不不合理损害本社合法利益的前提下，用户可在法律允许的合理使用范围内使用本社已发表作品。典型情形包括为个人学习、研究、欣赏而进行的少量复制；为介绍、评论某一作品或说明某一问题在作品中适当引用；为新闻报道在作品中不可避免地再现或引用；课堂教学或科研（非商业目的）为少量使用等。前述情形应遵守“必要限度”“适当引用”“保留权利标识”“注明来源及作者（如适用）”“不得构成对原作品的实质性替代”等要求。
• 法定许可、强制许可等以法律明确规定为限，依法支付报酬或履行公告义务的，应按法定程序办理。

5. 许可申请与授权规范

• 需要超出合理使用范围使用本社作品的，须事先取得本社书面授权。申请应载明：拟使用作品与权利类型、使用方式、范围、期限、地域、载体、是否转授权、技术条件、权利标识呈现方式及报酬安排等。授权以双方签署书面许可协议为准；未获明确书面许可的，视为未获授权。
• 对涉未成年人、教材教辅、考试系统、生成式人工智能训练/微调/推理、数据产品或商业数据库等高敏感、高风险用途，本社保留附加条件与合规审查之权利。

6. 第三方权利与开源/开放内容

• 本社平台或出版物中可能包含第三方享有权利之内容、商标或素材。该等权利由原权利人依法享有，除非本社另有明示许可或注释，不构成本社对使用者的转授权。
• 如本社明确标示某内容适用开放许可（如Creative Commons等），以该等许可条款与标注为准；未被明确标注者，不推定为开放许可。

7. 侵权投诉与反通知机制

• 若认为本社作品或平台内容涉嫌侵害您的合法权利，权利人或其合法授权代理人可向本社提交通知。有效通知应至少包含：权利人姓名/名称及有效联系方式；权属证明；明确的涉嫌侵权内容定位信息（包括页面/作品名称、链接、章节/页码/时间码等）；构成侵权的初步证据；权利人就通知材料真实性、合法性、完整性的声明与签字/盖章（电子签名合法有效的，依相关法律视同）。
• 本社将在收到合格通知后依法及时处理，并可视情采取删除、屏蔽、断开链接、限制功能或下架等措施。被通知人主张不侵权的，可依法提起反通知并提供相应证据。本社将在法律框架内据以恢复或维持相关内容，并保留将争议提交司法或行政程序的权利。
• 恶意或重大过失提交通知造成损害的，通知人依法承担相应法律责任。

8. 免责声明与风险控制

• 基于行业通行技术与商业合理努力，本社对内容进行权属管理与合规审查；惟对于因客观限制或第三方原因造成之技术误差、传播延迟、外链变更或第三方侵权行为等，本社不就超出法定范围的事项承担保证责任。
• 对转载、引用之作品或观点，仅出于信息传播或学术交流目的，不代表本社立场。使用者据此从事之行为，应自担法律风险与合规责任。

9. 法律适用与争议解决

• 本声明的订立、效力、解释、履行与争议解决，适用中华人民共和国法律，包括但不限于《中华人民共和国著作权法》《信息网络传播权保护条例》《中华人民共和国民法典》《出版管理条例》《中华人民共和国商标法》及最高人民法院相关司法解释。
• 因本声明或使用本社作品引发或与之相关的任何争议，由本社住所地有管辖权的人民法院专属管辖。

10. 更新与解释

• 本社保留根据法律变化、业务调整或权利管理需要对本声明进行修订的权利；修订自发布之日起生效，除非另有明确约定。
• 本声明由岚山书社统一发布与解释；就本声明未尽事宜，依照现行法律法规及行业规范处理。
