Youth Basketball Tryout Camp Assumption of Risk, Release of Liability, Indemnification, and Medical Authorization
This Assumption of Risk, Release of Liability, Indemnification, and Medical Authorization (Agreement) is entered into by the undersigned Parent/Legal Guardian (Signer) on behalf of the minor Participant identified below, and, if the Participant has reached the age of majority, also by the Participant, in favor of [Camp/Provider Legal Name], its officers, directors, managers, members, employees, coaches, athletic trainers, contractors, volunteers, agents, sponsors, venue owners/lessors, and affiliated entities (collectively, Released Parties).
Parties and Activity 1.1 Participant: [Full Legal Name of Minor Participant], Date of Birth: [MM/DD/YYYY] 1.2 Parent/Legal Guardian: [Full Legal Name]; Relationship: [Parent/Guardian] 1.3 Provider/Camp: [Legal Name], doing business as [Camp Name] 1.4 Activity: Youth basketball tryout camp, including skill drills, scrimmages, conditioning, strength and agility exercises, and related training and evaluation activities (Camp). 1.5 Dates/Location: [Dates], at [Facility Name and Address] 1.6 Governing Law and Venue: This Agreement is governed by the law of the State of [State], with exclusive venue in [County/State], except to the extent superseded by mandatory law. If the chosen state restricts or prohibits pre-injury releases for minors and/or recreational facilities, Sections 3–4 are to be construed and enforced to the maximum extent permitted by that law, as further provided in Section 11 (Severability; Savings).
Acknowledgment of Inherent Risks; Assumption of Risk 2.1 The Signer understands and acknowledges that basketball, athletic conditioning, and related activities involve inherent risks that cannot be eliminated without jeopardizing the essential qualities of the Camp. Such risks include, without limitation: slips, trips, and falls; collisions with players or equipment; struck-by-ball injuries; sprains, strains, fractures, concussions or other traumatic brain injuries; overexertion, dehydration, heat illness; cardiac or respiratory events; muscle or tendon tears; eye, dental, and facial injuries; communicable disease exposure (including respiratory viruses); premises defects; and transportation or ingress/egress incidents. 2.2 Voluntary Assumption. To the fullest extent permitted by law, the Signer, on behalf of the Participant, knowingly, voluntarily, and expressly assumes all risks of injury, illness, death, or property damage arising out of or related to the Camp that are inherent in such activities or that are otherwise reasonably foreseeable in connection with youth basketball activities.
Release and Waiver of Liability (Ordinary Negligence Only) Important: Many states prohibit releases for gross negligence, recklessness, or willful/wanton misconduct. This Section is intended to release only claims permitted by applicable law. 3.1 To the fullest extent permitted by law, the Signer, on behalf of the Participant and the Participant’s heirs, estate, and assigns, hereby releases and discharges the Released Parties from any and all claims, demands, causes of action, damages, losses, costs, and liabilities of any kind, in law or equity, for personal injury, illness, death, or property damage arising out of or related to the Participant’s attendance at or participation in the Camp that result from the ordinary negligence of any Released Party. 3.2 This release does not apply to gross negligence, reckless conduct, willful or wanton misconduct, or any conduct for which releases are prohibited by applicable law.
CONSPICUOUS NOTICE: BY SIGNING THIS DOCUMENT, YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR ORDINARY NEGLIGENCE, TO THE EXTENT PERMITTED BY LAW.

Indemnification and Hold Harmless 4.1 To the fullest extent permitted by law, the Signer agrees to indemnify, defend, and hold harmless the Released Parties from and against any third-party claims, demands, causes of action, damages, losses, costs, or liabilities (including reasonable attorneys’ fees) arising out of or related to the Participant’s acts or omissions, breach of this Agreement, or participation in the Camp, except to the extent caused by the gross negligence or willful misconduct of a Released Party or as otherwise prohibited by law. 4.2 If any release of negligence in Section 3 is held unenforceable under applicable law (for example, under state statutes invalidating releases for certain recreational facilities), this indemnity shall be construed and enforced to the maximum extent permissible and independent of Section 3.
Medical Authorization; Health Disclosures; Insurance 5.1 The Signer certifies that the Participant is physically fit and able to safely participate in the Camp; has disclosed any relevant medical conditions, allergies, or restrictions; and will comply with any recommended protective equipment and safety instructions. 5.2 Emergency Care. The Signer authorizes the Released Parties and emergency medical personnel to secure and provide emergency medical evaluation, treatment, or transportation for the Participant as deemed necessary under the circumstances, and agrees to be responsible for all associated costs. 5.3 Insurance. The Signer understands and agrees that the Released Parties do not provide accident or medical insurance for participants and that the Signer is responsible for obtaining and maintaining adequate health/medical insurance for the Participant.
Rules, Safety, and Removal 6.1 The Participant agrees to comply with all Camp rules, codes of conduct, and coach/trainer instructions. 6.2 The Provider may, in its sole discretion, remove the Participant from the Camp for unsafe behavior, rule violations, or health/safety reasons, without refund, to the extent permitted by law.
Communicable Diseases 7.1 The Signer acknowledges the contagious nature of communicable diseases and voluntarily assumes the risk that the Participant may be exposed to or infected by a communicable disease through participation in the Camp, and that such exposure or infection could result in personal injury, illness, disability, or death. 7.2 The Signer agrees that the Participant will not attend the Camp while experiencing symptoms of a communicable illness in contravention of applicable public health guidance.
Media; Name, Image, and Likeness (Optional—use as permitted by law) 8.1 The Signer consents to the capture and use of the Participant’s image, voice, and likeness in photographs, videos, or other media recorded during the Camp for Provider’s non-commercial promotional and archival purposes, without compensation, in any medium now known or later developed. If local law requires a separate, standalone consent or permits revocation, adjust accordingly.
Minor Status; Authority; Effect on Parents’ Own Claims 9.1 The Signer represents and warrants that the Participant is a minor and that the Signer is the Participant’s parent or legal guardian with legal authority to execute this Agreement on the Participant’s behalf. 9.2 The Signer understands that, in some jurisdictions, a parent/guardian may not waive a minor’s own prospective claims for negligence. In such jurisdictions, this Agreement shall be construed as (a) an express assumption of risk by the Signer on behalf of the minor to the maximum extent permitted; (b) a waiver of the Signer’s and the family’s derivative/personal claims (including loss of consortium/services) to the extent permitted; and (c) an agreement to indemnify under Section 4 to the extent permitted by law. 9.3 If the Participant has reached the age of majority under applicable law, the Participant signs below and personally agrees to all terms herein.
Dispute Resolution (Optional; tailor for minors and local law) 10.1 Good-Faith Negotiation. The parties shall attempt in good faith to resolve disputes arising out of or related to this Agreement within 30 days before filing suit or demanding arbitration. 10.2 Arbitration/Mediation. [Optional: Insert mediation or arbitration provision compliant with governing state law, AAA/JAMS rules, class waiver, and carve-outs for injunctive relief or claims not subject to arbitration. Note: enforceability against minors varies; use caution and obtain local counsel review.]
Severability; Savings; Conspicuousness 11.1 If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force to the maximum extent permitted by law. 11.2 To the extent a jurisdiction prohibits pre-injury releases of negligence for minors or for recreational facilities that charge a fee, Sections 3–4 shall be interpreted to provide the maximum lawful protection, including assumption of risk, waiver of parental/derivative claims, and indemnification, without releasing claims that cannot lawfully be released. 11.3 The Signer acknowledges that key risk allocation provisions are conspicuous and have been brought to their attention.
Entire Agreement; No Oral Modification; Execution 12.1 This Agreement constitutes the entire agreement with respect to the subject matter and supersedes all prior or contemporaneous understandings. No oral modifications are effective. 12.2 Electronic signatures or acceptance by electronic means are binding to the fullest extent permitted by law.
