城市音乐节观众风险告知与责任限制协议(免责条款) 重要提示: 1. 请您在确认购买或使用门票、领取证件及/或进入活动场地前,完整、认真地阅读本协议全部内容,尤其是以【重要条款】标注的关于风险告知、责任限制、争议解决与法律适用等条款。若您为未成年人,请在法定监护人陪同下阅读,并由法定监护人同意并签署。 2. 您勾选/签署/实际入场即视为已充分理解并同意受本协议约束。本协议系《中华人民共和国民法典》(含合同编与侵权责任编)、消费者权益保护相关法律法规框架下的格式条款。主办方已就可能免除或限制其责任的条款进行合理提示与说明。 3. 为符合法律的强制性规定,本协议不排除、限制主办方因故意或重大过失对人身损害承担的责任,亦不免除主办方依法应履行的安全保障义务及依法应承担的相应责任。 一、协议主体与定义 1. 甲方(主办方):(填写主办单位全称),地址:(填写),联系人:(填写),统一社会信用代码:(填写)。 2. 乙方(观众/购票人/持证人):姓名(名称):(填写);证件类型及号码:(填写);联系方式:(填写)。 3. “活动”系指由甲方于(填写日期)在(填写场地)举办的“(填写城市音乐节名称)”及其相关预热、延展、周边活动。“场地”系指活动举办范围内所有区域及其出入口、公共通道、临时设施等。“关联方”包括甲方雇员、受托人、承包商、安保、票务及经授权的合作伙伴。 二、风险告知与自愿参加 1. 乙方确认知悉并理解大型群体性演出活动存在的固有风险,包含但不限于:人群拥挤与推挤、跌倒与踩踏、地面湿滑、噪声及强光/频闪对听力或视觉可能造成的不适或伤害、烟火/特效/舞美装置运行风险、天气变化(高温、降雨、大风、雷电等)、野外/临时场地条件限制、传染性疾病暴露风险、第三人不当行为、个人财物遗失与被盗等。 2. 乙方承诺本人(及同行未成年人)身体健康、适合参与/观看演出;如存在心血管疾病、哮喘、癫痫、听力或光敏性问题、孕期、近期手术或医生建议避免站立久候、暴露于噪声及人群的情形,乙方已咨询医生并自行评估风险;必要时应自备耳塞、防雨、防晒等用品。 3. 乙方了解活动可能因不可抗力或为公共安全之必要而变更、延期、中止或取消(详见第七条)。 三、入场与安全管理 1. 乙方同意遵守现场秩序与所有公布或现场提示的观演规则,包括但不限于:实名/安检入场、禁止携带危险物品及法律法规禁止或经主办方明确禁止的物品、服从安保与工作人员的合理指引与疏导、不从事可能危及自身或他人安全的行为。 2. 乙方同意主办方及其安保为安全之目的实施合理的安全检查及必要的现场管控、分流、临时封控与紧急疏散措施。 3. 若乙方违反现场规则或相关法律法规,主办方有权拒绝其入场或要求其离场,必要时移交公安机关处理;因此产生的损失由乙方自行承担。 四、【重要条款】责任分配与限制 1. 甲方的法定义务与不可排除的责任 (1)甲方及场地方依法对活动现场负有合理的安全保障义务,包括制定并实施安全方案、合理设置安全设施、安排安保力量与应急预案、进行安全提示与必要告知、在接获危险信息时采取合理处置等。 (2)本协议不排除、不限制甲方因故意或重大过失对乙方人身损害承担的侵权责任;不减轻甲方依法应承担的补充责任或其他强制性法律责任。 2. 乙方自担风险的范围 (1)在甲方已履行合理的安全保障义务的前提下,因活动固有风险、乙方自身健康状况、不可预见且非因甲方过错导致的第三人行为、不可抗力或意外事件等造成的损害,乙方理解并自行承担相应风险与损失。 (2)乙方违反现场规则或法律法规而导致的任何损失或对第三人的损害,由乙方自行承担,甲方因此遭受的损失有权向乙方追偿。 3. 第三方与承包商 (1)因舞台、灯光、音响、特效、安保、票务等由经甲方委托的第三方实施的专业服务导致损害的,依照法律关于委托、承揽或安全保障义务及侵权责任的规定承担相应责任;甲方在法律规定范围内承担相应补充责任后,有权向实际侵权人追偿。 4. 财物安全 (1)乙方自行保管随身财物。非由甲方设置并明示“寄存/保管”服务的区域,不构成保管关系。因第三人盗窃、抢夺等违法行为造成的损失,非因甲方过错的,甲方不承担赔偿责任;但依法应承担的补充责任除外。 5. 医疗救助 (1)在突发伤病或紧急情形下,乙方同意甲方为保护人身安全之必要而协助联系现场医疗机构或实施合理的紧急救助。除因甲方过错导致的情形外,相关医疗费用由乙方自行承担。 6. 法律边界 (1)如本条款中有关责任限制的内容与法律的强制性规定相冲突,以法律规定为准;与乙方的法定消费者权益相冲突的,以消费者权益保护相关法律法规为准。 五、个人信息保护与肖像授权 1. 为履行本协议与组织活动之目的,甲方将基于最小必要原则收集、使用乙方的姓名、证件信息、联系方式、购票与入场记录、现场安保与通行记录等个人信息;并采取相应的安全措施进行存储与保护。除法律法规规定或经乙方另行同意外,不向无关第三方提供。个人信息处理将遵守个人信息保护相关法律法规。 2. 基于活动安保及秩序维护之必要,现场可能启用视频监控及人流统计设备;相关数据仅在必要范围和期限内留存。 3. 肖像及声音授权:乙方同意甲方在活动中进行现场拍摄、录音录像,并在与活动相关的报道、存档及合理的宣传中使用乙方的肖像、声音与形象(不构成对乙方名誉、隐私的不当利用)。乙方如有特殊限制或拒绝需求,可通过甲方公布的渠道在活动前提出,甲方将在合理范围内予以协助。 六、未成年人与随行观众 1. 未成年人观众须由法定监护人同意并在其全程监护、陪同与负责下入场观演;不同年龄段限制依活动公告执行。监护人应确保未成年人遵守现场规则并对其行为负责。 2. 监护人代表未成年人签署或确认本协议,并承担相应的民事责任。 七、票务、调整与不可抗力 1. 门票销售与使用规则以甲方/官方票务平台公示的购票条款为准。本协议与购票条款不一致的,以更有利于消费者的约定或法律强制规定为准。 2. 因不可抗力或为公共利益与公共安全之必要(包括但不限于极端天气、自然灾害、突发公共卫生事件、政府指令或政策调整、场地突发状况、不可预见的安全风险等),甲方有权在必要范围内变更、延期、中止或取消活动,并依法或依约处理票务退改事项。 3. 非因甲方过错导致的演出阵容调整、节目时长微幅变动、非实质性座位或区域调整等,不构成违约;如构成重大变更,依法律及公示规则处理。 八、保险与风险管理 1. 甲方将依法律要求配置必要的公共安全与责任保障措施;乙方理解公共责任保险(如已投保)为第三者责任保障,并非对每一损失的保证赔付。 2. 建议乙方根据自身情况投保人身意外伤害保险或其他适当保险。 九、争议解决与适用法律【重要条款】 1. 本协议的订立、效力、解释、履行及争议解决适用中华人民共和国大陆地区现行法律法规。 2. 因本协议产生或与本协议有关的争议,双方应先行友好协商;协商不成的,任何一方均可向活动举办地有管辖权的人民法院提起诉讼。 十、协议的生效、解释与其他 1. 本协议自乙方线上勾选同意/签署或实际入场之时生效;对无票入场、换证入场及持邀请/工作证件入场者同样适用。 2. 本协议构成双方就风险告知与责任分配的完整约定;与本协议目的相关的公告、现场提示、安检与安全须知为本协议的有效组成部分。若与购票条款存在冲突,以不减损消费者法定权利为原则进行解释。 3. 可分割性:本协议任何条款被认定无效或不可执行的,不影响其他条款的效力;就被认定无效或不可执行的部分,应在法律允许的最大范围内进行变更或解释以实现其目的。 4. 提示与说明确认:甲方已对本协议中免除或限制其责任、争议解决与法律适用等与乙方利益有重大关系的条款以加粗/显著标识、弹窗或现场公告等合理方式作出提示并提供了充分的说明渠道;乙方确认已阅读、理解并同意。 签署页(如为线下签署使用) 乙方(观众/购票人): 签名(盖章):____________________ 证件号码:________________________ 签署日期:____年__月__日 未成年人监护人(如适用): 监护人姓名:_____________________ 与未成年人关系:_________________ 证件号码:________________________ 签名:____________________________ 签署日期:____年__月__日 主办方(甲方): 单位全称(盖章):________________ 授权代表签字:____________________ 签署日期:____年__月__日 合规与适用说明(供内部使用或对外公示时一并提示) - 本协议作为格式条款使用时,主办方应在售票页面、入场系统与现场入口对【重要条款】履行显著提示与合理说明义务,并提供便捷的咨询与下载留存渠道。 - 本协议不免除因主办方故意或重大过失造成乙方人身损害的责任;不排除或限制乙方依法享有的消费者权利;不减轻主办方依法应承担的安全保障义务与相应补充责任。若需适配特定城市/场地监管要求、防疫政策或票务细则,请结合当地主管部门规范进行相应调整。

This is a legal contract that affects your rights. By signing below, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement. 1. Parties and Event This Release and Waiver of Liability, Assumption of Risk, Indemnity, and Media Consent Agreement (the Agreement) is entered into by and between: - Participant: [Full Legal Name], [Date of Birth], [Address], [Email], [Phone], and if applicable, Parent/Legal Guardian identified in Section 17; and - Organizer: [Organizer Legal Name], a [jurisdiction and entity type], together with its directors, officers, employees, volunteers, contractors, medical providers, agents, sponsors, advertisers, vendors, landowners/lessors/lessees, public agencies and land managers, venue operators, insurers, successors, and assigns (collectively, the Released Parties). Voluntary Participation and Capacity Participant represents that they are entering this Agreement knowingly and voluntarily, are of legal age and capacity to contract, or have obtained the signature and consent of a parent/legal guardian if a minor. Acknowledgment and Assumption of Risks Participant understands that mountain trail running is an inherently hazardous activity that involves known and unknown risks that cannot be eliminated without jeopardizing the essential nature of the Event. These risks include, without limitation: - Falls; slips; trips; collision with terrain features; rockfall; landslides; loose gravel; roots; cliffs; snow and ice; water crossings; avalanche or mudflow; and other natural hazards. - Extreme and rapidly changing weather; exposure; hypothermia; hyperthermia; dehydration; altitude illness; sunburn; lightning; wildfire and smoke; limited shade and shelter. - Remote location hazards; delayed or limited emergency response; limited or no cell service; navigational errors; getting lost; fatigue; impaired judgment. - Wildlife encounters; insects and bites/stings; poisonous plants; waterborne or foodborne illness; communicable diseases, including viral or bacterial infections. - Participant’s own equipment failure; improper gear; inadequate training or conditioning; known or unknown medical conditions; and errors in judgment. - Risks arising from the acts or omissions (including ordinary negligence) of other participants, spectators, volunteers, medical personnel, and the Released Parties, including course design or marking, selection or maintenance of routes, and provision or failure to provide warnings, aid, instructions, or rescue. Participant freely and expressly assumes all such risks, both known and unknown, foreseeable and unforeseeable, including those arising from the ordinary negligence of the Released Parties, to the maximum extent permitted by applicable law. 4. Release and Waiver of Liability; Covenant Not to Sue To the fullest extent permitted by applicable law, Participant, on behalf of themselves and their heirs, executors, administrators, personal representatives, and assigns, hereby: - Releases and forever discharges the Released Parties from any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses of any kind (including attorneys’ fees) arising out of or related to Participant’s participation in or presence at the Event, whether occurring before, during, or after the Event, including travel to and from the Event, whether based on tort, contract, statute, or any other legal theory, and whether caused in whole or in part by the ordinary negligence of the Released Parties; - Agrees not to sue the Released Parties for any claim released herein (Covenant Not to Sue); and - Agrees that this Release specifically and conspicuously covers the ordinary negligence of the Released Parties, is intended to satisfy any applicable “express negligence” or “primary assumption of risk” doctrine, and is intended to be as broad and inclusive as permitted by applicable law. This Release does not waive claims that cannot legally be released, including claims for gross negligence, reckless misconduct, willful or intentional misconduct, or where otherwise prohibited by law. 5. Indemnification and Hold Harmless To the fullest extent permitted by law, Participant agrees to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, demands, causes of action, damages, judgments, liabilities, fines, penalties, costs, and expenses (including reasonable attorneys’ fees and costs) arising out of or related to: - Participant’s participation in, presence at, or conduct during the Event; - Participant’s breach of this Agreement or the Event rules; and/or - Claims asserted by third parties, including co-participants, resulting from Participant’s acts or omissions. This obligation applies even if a Released Party is alleged or found to be negligent, but does not apply to the extent of gross negligence, reckless, willful, or intentional misconduct by a Released Party to the extent such claims cannot be legally waived or indemnified. 6. Health, Fitness, and Medical Authorization - Participant certifies they are physically fit, have sufficiently trained for the Event, and have not been advised otherwise by a qualified medical professional. Participant is solely responsible for managing medications and any medical conditions. - Participant consents to the provision of first aid and to emergency medical care and transportation as deemed necessary by the Organizer or medical personnel, and agrees to be financially responsible for all associated costs. - Participant authorizes the release of medical information to and from medical personnel for treatment purposes and to the Organizer for incident management. 7. Equipment, Mandatory Gear, and Course Changes Participant agrees to comply with Organizer’s rules and mandatory gear requirements, to inspect equipment before use, and to withdraw from the Event if unsafe conditions are observed. Participant understands the Organizer may, in its discretion and for safety or legal reasons, alter the course, start time, cut-off times, or format; neutralize, delay, or stop the Event; disqualify Participant; or cancel the Event. Unless prohibited by law or stated otherwise in Organizer’s written refund policy, fees are non-refundable and entries are non-transferable. 8. Compliance with Laws and Rules; Alcohol and Substances Participant agrees to abide by all Event rules, instructions, and applicable laws and regulations, including environmental, fire, and land-use restrictions, and agrees not to use performance-enhancing drugs or participate while impaired by alcohol or any substance. 9. Premises and Land Use Participant understands the Event occurs on property owned or managed by public agencies and/or private landowners. Participant agrees to respect all property, stay on marked routes, and follow land manager directives. This Agreement extends to claims arising from premises conditions, maintenance, inspection, marking, or warnings. 10. No Warranties; Participant Responsibility Organizer makes no warranty, express or implied, regarding the safety, condition, or suitability of the Event, course, or premises. Participant accepts the Event and premises “as is” and is responsible for their own safety and decision-making at all times. 11. Photographs, Recordings, and Likeness Participant grants the Organizer a perpetual, worldwide, royalty-free license to use Participant’s name, image, voice, likeness, and biographical information captured in connection with the Event, in any media, for legitimate promotional and informational purposes, without further notice or compensation, to the extent permitted by applicable law. 12. Personal Data Participant consents to the collection, use, disclosure, transfer, and storage of personal data for Event administration, safety, timing, results publication, communications, and compliance purposes, in accordance with Organizer’s Privacy Notice available at [URL]. Participant understands that results, photos, and rankings may be publicly posted. 13. Governing Law; Venue; Dispute Resolution - Governing Law: This Agreement and any dispute arising out of or related to it shall be governed by the laws of [State/Country], without regard to its conflict-of-laws rules. - Venue and Jurisdiction: The exclusive venue for any permitted court action shall be the state or federal courts located in [County, State/Country], and the parties consent to personal jurisdiction there. - Jury Trial Waiver: To the extent permitted by law, the parties waive the right to a jury trial in any dispute arising out of or relating to this Agreement or the Event. Severability; Reformation If any provision of this Agreement is determined to be invalid or unenforceable as written, it shall be enforced to the maximum extent permissible and the remainder shall continue in full force. The parties authorize a court or tribunal to modify any unenforceable provision to the minimum extent necessary to render it enforceable (blue-pencil/reformation). 16. Entire Agreement; No Reliance; No Assignment This Agreement constitutes the entire understanding between the parties regarding its subject matter and supersedes all prior discussions. Participant has not relied on any statements not expressly set forth herein. Participant may not assign this Agreement. Organizer may assign this Agreement to an affiliate or successor in interest. 17. Minors; Parent/Guardian Consent If the Participant is under the age of majority in the governing jurisdiction: - The undersigned Parent/Legal Guardian represents they are the legal parent/guardian with authority to enter this Agreement on the minor’s behalf, consents to the minor’s participation, and agrees to all terms herein on behalf of the minor and themselves. - The Parent/Legal Guardian further agrees to defend, indemnify, and hold harmless the Released Parties from any claims by or on behalf of the minor Participant to the extent permitted by law. Note: Some jurisdictions prohibit or limit enforcement of pre-injury waivers signed on behalf of minors. This Agreement is intended to be effective to the fullest extent permitted by applicable law. 18. Conspicuousness and Acknowledgment Participant acknowledges that the provisions regarding assumption of risk, release of liability for ordinary negligence, covenant not to sue, indemnity, jury trial waiver, and class action waiver are conspicuous, negotiated to the extent desired, and understood. Participant had the opportunity to seek independent legal advice before signing. 19. Electronic Signature; Counterparts Participant agrees that electronic signatures and records related to this Agreement are valid and enforceable to the fullest extent permitted by applicable electronic transactions law, and that this Agreement may be executed in counterparts. 20. Effective Date This Agreement becomes effective on the date signed below and applies to the Event identified above and any Organizer-sanctioned pre-Event or post-Event activities related thereto.
